Notice on Implementing the Regulation Strictly Prohibiting the Use of Tobacco, E-cigarettes and Heated Tobacco Within the University Campus and Disciplinary Handling of Violations

In the past period, the University has regularly announced and reminded all learners and employees of the regulation strictly prohibiting the use of tobacco, e-cigarettes and heated tobacco within the University campus. In order to continue strengthening the sense of compliance with the law and the internal rules and regulations, the University issues this notice reminding of the implementation of the regulation strictly prohibiting the use of tobacco, e-cigarettes and heated tobacco within the University campus and disciplinary handling of violations, specifically as follows:

1. The use of tobacco, e-cigarettes and heated tobacco is absolutely strictly prohibited throughout the entire University campus.

2. The forms of penalty and discipline applied to learners and employees who violate the regulation prohibiting the use of tobacco, e-cigarettes and heated tobacco are as follows:

* For the act of using tobacco, e-cigarettes and heated tobacco within the University campus:

– The act of smoking tobacco at a location where it is prohibited is fined from 200,000 VND to 500,000 VND. (Clause 1, Article 24, Decree 90/2026/NĐ-CP)

– The act of using e-cigarettes and heated tobacco is fined from 3,000,000 VND to 5,000,000 VND and requires the destruction of the e-cigarettes and heated tobacco. (Clauses 1 and 3, Article 26, Decree 90/2026/NĐ-CP)

– For learners of the full-time training system: 02 conduct points are deducted per violation under Article 5 of the Student Conduct Scoring Table for each semester. Violations from the third time onwards are reported to the Disciplinary Council, which considers disciplinary levels from reprimand to warning, records them in the student’s file and notifies the student’s family of the disciplinary decision.

– For second-degree and postgraduate learners and employees, violations are handled according to the University’s regulations and labour rules.

* The act of illegally producing, trading, transporting or storing e-cigarettes and heated tobacco: shall be criminally prosecuted for the Crime of producing and trading prohibited goods. (Article 190, the 2015 Penal Code (amended and supplemented in 2017))

3. The University requests that when learners and employees detect the act of using tobacco, e-cigarettes or heated tobacco within the University campus, they please immediately notify the Department of Political Affairs – Student Affairs (CT-CTSV), the Department of Organisation – Administration (TC-HC), the Boards of the Faculties or the relevant units to coordinate handling in accordance with the regulations. All reported information will be kept absolutely confidential.

4. The Department of Political Affairs – Student Affairs coordinates with the Department of Organisation – Administration, the Boards of the Faculties, the Youth Union – Student Association, the Department of Postgraduate Training – Science and Technology, the Institute of Training & Applied Research, the Centre for Culture and Facilities and relevant units to strengthen communication on preventing and combating the harms of tobacco and to regularly conduct surprise inspections in areas within the University, especially areas frequently reported to have tobacco use.

5. In cases where the violation causes fire-safety hazards or affects the security of the area, the University will transfer the file to the police authority for consideration and handling in accordance with the provisions of the law.

The University requests learners, employees and relevant units to seriously implement the legal regulations on preventing and combating the harms of tobacco, and at the same time comply with the University’s rules and regulations, joining hands to build a civilised – safe – healthy learning and working environment at HUFLIT, towards the goal of a “Smoke-free school”.
